Summary of facts

Mr Davidson alleged that Mr Moseley in Race 2, allowed his mount NANA JAY to shift inwards passing the 250 metres when not sufficiently clear of CANDIDATE (Mr K Mudhoo) which was crowded and checked.

Ms Algar, Stipendiary Steward, demonstrated on the films that Mr Moseley was 2 wide at the back of the field nearing the 250 metres. He shifted in and, in so doing, tightened the horse to his inside ridden by Mr Mudhoo. Mr Mudhoo had to check his mount and take hold. Mr Davidson demonstrated on the videos that Mr Moseley was not his length and another clear when shifting.

Mr Moseley said the cut-away rail had contributed to the incident and that both horses involved were green horses having their first start. He said he was aware Mr Mudhoo was there and thought he had given him enough room. While he admitted the charge, he believed had been close to being clear of Mr Mudhoo.

Decision as to breach

As Mr Moseley has admitted the breach, it is found to be proved.

Submissions as to penalty

Mr Davidson said the breach was low range when regard was had to the greenness of the horses. He produced the Respondent’s record which showed one suspension in the last 12 months when Mr Moseley was suspended for 5 days on 16 October. He described Mr Moseley’s record as being extremely good.

Mr Moseley agreed with the Stewards’ assessment of the gravity of the breach as being low end. He emphasised his very good record and that he had only had one breach of the Careless Riding Rule in the past 12 months.

Mr Moseley sought a deferment of any suspension that the Adjudicative Committee was to impose until after the Riccarton meeting on 27 March.

Decision as to penalty

The breach is low range. The horses were both having their first starts. Mr Moseley has shifted inwards and crowded Mr Mudhoo. The obligation on Mr Moseley is to be his length and another clear. He was not when he shifted towards the rail.

The starting point is 5 national days. Mr Moseley’s record is excellent. His last breach is 6 months ago, and this is only his second breach in a 12-month period. He is a very busy South Island Rider. He has had 478 rides this season and 266 since his previous breach. A day’s credit is appropriate for this and his admission of the breach.

Mr Moseley’s licence is suspended for 4 National days. This is from the end of racing on 27 March up to and including 3 April 2022.
