Evidence:

Following the running of Race 1 Chief RIB Steward, Mr John Oatham charged Mr Campbell for breaching Rule 638(3)(f)(ii) in that he used his whip in the final straight above shoulder height.

Mr Oatham demonstrated on the video replay Mr Campbell, who was racing against the rail, strike his horse five times in the home straight with his arm raised above shoulder height.

Mr Campbell agreed with Mr Oatham’s submissions and had nothing to add.

Submissions on Penalty:

Mr Oatham stated Mr Campbell had been warned under this Rule on 13 August 2022. He said he was subsequently charged with a breach of the Rule on 17 September 2022 where he was fined $250.

Mr Oatham said there are no provisions in the Guidelines for a second breach of this Rule but in the main Adjudicative Committees have duplicated penalties of whip offences for Rule 638(3)(g)(i) which provide a $500 fine as penalty.

Mr Campbell made no submissions on penalty.

Reasons for Penalty:

The draft for the proposed new Penalty Guidelines hopefully addresses this anomaly, however, in this case, a fine of $500 is considered an appropriate penalty for Mr Campbell.

Conclusion:

Class A Jockey, Mr Corey Campbell is fined $500.
