EVIDENCE:
Following the running of Race 2, the Respondent, Class A Rider Corey Campbell admitted a charge alleging that he used his whip with his arm raised above shoulder height when riding VERMONT over the concluding stages.
Rule 638(3)(f) provides that a Rider must not use his or her whip:
(ii)  using an action that raises the Rider’s arm above shoulder height.
Using the available video replays, Stipendiary Steward, Veronica Algar, demonstrated that the Respondent struck his mount on 3 occasions approaching the 100-metre mark, using an action with the whip that raised his arm above shoulder height.
Mr Campbell agreed with the Stewards’ assessment of the incident.
DECISION:
As the Respondent, Mr Campbell has admitted the breach, the Adjudicative Committee finds the breach proved.
SUBMISSIONS FOR PENALTY:
Mr Oatham produced the Respondent, Mr Campbell’s record, which indicated no previous breaches of this particular Whip Rule within the last 6 months.
Mr Oatham stated that there was no starting point for an initial breach of this particular Rule in the Penalty Guidelines, but submitted that recent historic penalties showed a starting point of $250 was being adopted.
Mr Campbell made no submissions in regard to penalty.
REASONS FOR PENALTY:
This Adjudicative Committee, after taking into consideration the fact that this was Mr Campbell’s 1st breach, and after researching historic penalties under this particular Rule, determined that a fine of $250 was an appropriate penalty in this case.
CONCLUSION:
The Respondent is fined the sum of $250.
