EVIDENCE:

Following the running of Race 8, an Information was presented by Stipendiary Steward Ms Veronica Algar, alleging a breach of Rule 638(1)(d) by Jockey Ms Kylie Williams.

Ms Williams stated she was conversant with the Rule, understood the charge and she confirmed she admitted the breach.

Ms Algar had Mr Oatham identify Ms Williams drawn the outside barrier and Mr Krishna Mudhoo (MAKE BELIEVE), who was drawn 6 in the 1200m race. Mr Oatham pointed to Ms Williams begin quickly and as she shifted inwards, was not sufficiently clear of Mr Mudhoo, who was forced to check.

Ms Williams said she was aware Mr Mudhoo was to her inside, but she misjudged her manoeuvre.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Ms Algar stated that Ms Williams had 2 previous breaches of this Rule in the past 12 months. The first in June last year, and the second in February 2023, and considering she has had 441 rides in that period, represents a very good record.

Ms Algar said the Stewards see this breach as low level and would leave it to the Adjudicative Committee to arrive at an appropriate Penalty.

Ms Williams asked if she could begin any Penalty after racing at Wingatui on 26 May 2023.

REASONS FOR PENALTY:

The Thoroughbred Penalty Guidelines provide a 5-day suspension for a low-level breach of the Rule, which this is. Ms Williams has a very good record regarding the Rule and has admitted the breach, which entitles her a discount in Penalty, which the Adjudicative Committee sets at one day, resulting in a 4-day suspension.

Ms Williams’ request for deferment is granted.

CONCLUSION:

Jockey Ms Kylie Williams’ Licence to ride in races is suspended from the conclusion of racing on 26 May 2023, up to and including racing on 2 June 2023.
