Evidence:

Following the running of Race 10 the Respondent Class A Rider Miss K Williams admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d) by Stipendiary Steward Mr M Davidson. The Information alleged that as the Rider of HEIDI HI, Miss Williams angled her mount outwards crowding and checking LETSBRINGITON (T Comignaghi), FIRODEN (J Lowry), RIVIERA ROCK (B Murray), TAPPY’S ONE (D Bothamley).

The Respondent acknowledged she understood the Rule and confirmed her admission of the breach.

Rule 638(1)(d) provides:  A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Submissions:

Using the available race films, Stipendiary Steward Mr V Munro demonstrated the incident and identified the horses and Riders concerned.

Mr Munro highlighted the outward movement of HEIDI HI which crowded and checked LETSBRINGITON and FIRODEN. RIVIERA ROCK and TAPPY’S ONE were also affected but not as significantly as the prior two horses.

In response, the Respondent Miss Williams stated that she had simply made an error of judgement and had come out too soon. She did believe however that the outside horses (RIVIERA ROCK and TAPPY’S ONE) may have been moving inwards also and contributed slightly to the incident.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach approved.

Submissions For Penalty:

Stipendiary Steward Mr Davidson produced the Respondent Miss Williams’ riding record which indicated one previous breach of the Rule on 25/02/2022 at the Canterbury Jockey Club where she was suspended for four days.

Mr Davidson believes the range of carelessness was at the higher end of the scale and that it needed to be noted that the Riverton Cup was a listed race. Mr Davidson however also noted that Miss Williams had admitted the breach at the earliest moment which some credit may be given for.

The NZTR Revised Penalty Guidelines 1st March 2022 states that for a midrange careless riding charge a seven days national suspension is recommended. Mr Davidson stated that a 7-8 day suspension may be appropriate in this instance.

Miss Williams had no submissions on penalty.

Reasons For Penalty:

After considering all submissions, the Adjudicative Committee determined the Respondent Miss Williams’ carelessness to be midrange and adopted a 7 day (suspension) as the starting point. This conforms with the NZTR Revised Penalty Guide as of 1st March 2022.

An additional 1 day uplifts the penalty to 8 days because of the race being a stakes listed race and a 1 day reduction was applied to the 8 days for her admission of the breach.

After consideration of the above factors, a 7 day suspension was imposed.

Conclusion:

The Respondent’s request for a deferment is granted and her license to ride in races in suspended for a period of 7 days commencing at the conclusion of racing on 24 April 2022 until the conclusion of racing on the 1 May 2022 (7 national riding days).
