Following the running of Race 4, the Respondent Class A Rider Miss K Williams, admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d).  The Information alleged that as the Rider of DUBAI LADY permitted her mount to shift inwards after the start when not sufficiently clear causing crowding to TADITA and TRUTHBETOLD which were both checked.  

The Respondent acknowledged  she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using the available race films Stipendiary Steward V Algar, with the assistance of Chief Stipendiary Steward, Mr J Oatham, demonstrated the incident and identified the horses and Riders concerned.

Stipendiary Steward V Algar said that shortly after the start the Respondent has shifted ground inwards when only a bare length ahead of TADITA, ridden by Mr C Johnson, who was tending to over race, and TRUTHBETOLD, ridden by Mr J Kamaruddin, causing both horse to be checked.

In response, the Respondent stated that Mr Johnson had wanted to let her go forward but his horse was over racing and contributed to the incident.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.

Submission for Penalty:

Stipendiary Steward V Algar produced the Respondent, Miss Williams’, riding record which indicated 1 previous breach on 26 February 2021, where she received a 12 day suspension at Riccarton, under the Careless Riding Rule in the last 12 months.

Stipendiary Steward V Algar said Stewards assessed the level of carelessness to be in the low range and submitted a suspension commensurate with the Penalty Guideline.

The Respondent advised of riding engagements through until 5 March at Otago and sought a deferment to any proposed suspension.

In terms of any proposed penalty the Respondent Miss Williams made no submissions.

Reasons for Penalty:

After considering all submissions the Adjudicative Committee determined the Respondent Miss Williams’ carelessness to be in the low range and adopted a 5-day (suspension) as the starting point. This conforms with the NZTR Penalty Guide (as of 1 September 2021).

The Respondent’s riding record is treated as a neutral factor as she was only 1 day short of a 12 month period since her last suspension and a 1-day reduction was applied to the 5-day starting point for her admission of the breach and record. There were no aggravating factors to consider, therefore no uplift warranted.

After consideration of the above factors a 4-day suspension was imposed.

Conclusion – Penalty:

The Respondent’s request for a deferment is  granted and her licence to ride in races is suspended for a period of 4 days commencing after racing on 5 March 2021 and concluding after racing on 12 March 2021.
