EVIDENCE

Following the running of Race No 9, the “TRG Toyota/Waitomo Group 1600” Mr Davidson presenting an Information charging Ms Sutherland with a breach of the excessive whip Rule 638(3)(g)(i) in that she used the whip excessively prior to the 100 metre mark.

Ms Sutherland, assist my Ms K Clapperton, admitted the breach.

The Race films illustrated that Ms Sutherland reding “ECHO BAY” struck her mount with her whip 7 times when in the home straight and prior to the 100 metres point.

DECISION

As the breach was admitted it was found proved.

SUBMISSIONS ON PENALTY

Mr Davidson advised that Ms Sutherland had a blameless record and would only have received a warning, but such could only be given where there was 1 additional strike (over the 5 strike limit) but here there were 2 additional strikes.

Ms Clapperton advised that Ms Sutherland has had very limited riding opportunities to date, has just returned from a break because of a fall.  She said she was riding for the first time at Trentham which has a long straight which can be deceptive to and inexperienced Apprentice.

REASONS FOR PENALTY

Whilst the Penalty Guide records a “starting” point of $250, there are very substantial mitigating factors which are taken into account.  The “starting” point is generally aimed at Class A Senior Riders.  Ms Sutherland has had a very limited number of rides over the past year.  She has never been charged with any breach of the Rules.  She is a young (17 years old) Apprentice, with (so far) no appreciable income or financial resources.  A discount is required to allow for these factors.

PENALTY

Accordingly, a fine of $125 is imposed which forfeits almost all of her riding fee.
