BACKGROUND:

Following the running of Race 10, Martin Collins 161st New Zealand Cup (Group 3), Class B Jockey, Lily Sutherland, admitted a charge that, as the Rider of JUST CHARLIE in the race, she “struck her mount 7 times prior to the 100 metres and another 5 strikes inside the 100 metres”.

Ms Sutherland was assisted at the hearing by Apprentice Jockey Mentor, Jason Laking.

Rule 638 provides:

(g) Subject to the other requirements this Rule 638(3), in a Flat Race or trial (including jump-outs and/or tests for certification purposes), a Rider must not:

     (i) except as provided for in (iii) (A) and (iii) (B) of this sub-Rule, strike a horse with a    whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins).

EVIDENCE:

Chief Stipendiary Steward, John Oatham, showed a video replay of the final 200-300 metres of the race. He pointed out JUST CHARLIE, ridden by Ms Sutherland, the leader as the field turned into the home straight. Shortly thereafter, Ms Sutherland commenced using her whip and Mr Oatham showed that she used it seven times prior to the 100 metres and a further five times from the 100 metres to the finishing line.

Ms Sutherland did not wish to comment.

DECISION:

The charge having been admitted, it is deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham said that this is Ms Sutherland’s second breach. Her previous breach was on 7 July at Hawkes Bay for six plus six strikes, a $500 fine. In terms of the Penalty Guide, for this breach, being a second breach, the starting point is a $500 fine.

Ms Sutherland’s mount finished 4th in the race and, Mr Oatham said, earned a stake of $20,000. Ms Sutherland’s 50% share of the stake earned is, therefore, $500 – the same as the Penalty Guide starting point, he said.

Ms Sutherland had no submission to make concerning penalty.

REASONS FOR PENALTY:

However it is looked at, the RIB Thoroughbred Racing Penalty Guide (March 2024) starting point is a fine of $500. The race was a Group 3 Race for a stake of $400,000 and, accordingly, an uplift to that starting point is required. The Adjudicative Committee determined that an uplift of $150 was appropriate.

CONCLUSION:

Class B Jockey, Lily Sutherland, is fined the sum of $650.
