Penalty: Apprentice Jockey Lily Sutherland is fined $350

Evidence

Following the running of Race 10, the Ali Basti Equiworld Dubai 52nd New Zealand 2000 Guineas, the Respondent Class B Rider, Lily Sutherland admitted a charge alleging use of whip in consecutive strides, in that you used your whip in consecutive strides on 2 occasions in the rune home passing the 300m.

Apprentice Mentor Jason Laking was present to assist.

Rule 638(3)(g)(ii) provides that in a Flat Race a Rider must not:

(ii) strike a horse with a whip in consecutive strides at any stage of the race.

Using the available race films, Chief Stipendiary Steward Mr Oatham, demonstrated that the Respondent struck her mount 2 times consecutively near the 300m, when in contention.

Miss Sutherland stated that she just got excited when in contention and forgot the Rules momentarily.

Decision

As the Respondent Miss Sutherland admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submissions for Penalty

Mr Oatham produced the Respondent’s record, which indicated a warning earlier in the day.

He stated that this was therefore the Respondent’s 2nd offence, with the Penalty Guide providing a $150 starting point. Mr Oatham stated that this was a Black Type Race, Group 1 with a stake of $650,000. He said that under the Penalty Guide, in a Black Type Race, the starting point for a breach of this Rule was a fine equaling 50% of the Jockey’s share of the stake earned by their mount, which with HE’S LUCID finishing in 6th place earning $9750, Miss Sutherland’s share was approximately $250.

He submitted a fine around $300, be considered as penalty in this case.

Miss Sutherland elected to make no submissions in regard to penalty.

Reasons for Penalty

The Penalty Guide starting point for a breach of this nature is set out in the table below.

2 consecutive strikes -second offence $150 or if a Black Type 50% of  jockeys share of the stake earned by their mount, whichever is the greater.

The aggravating factor is the status of the race, being a Group 1 Race with a stake of $650,000, for which an uplift is warranted. This uplift was set at $100.

On that basis, the Respondent is fined $350.

Conclusion

The Respondent is fined $350.
