EVIDENCE:

After Race 5 Information A15608 was filed with the Adjudicator.  It was alleged that Ms Barnes used her whip in 4 consecutive strides on her mount “STYLISH SUGGESTION” over the concluding stages.

Ms Barnes said that she understood the Rule, Charge and confirmed that she admitted the breach.

Mr Oatham showed the films and identified where Ms Barnes struck her mount in 4 consecutive strides.

Ms Barnes agreed with the number.

REASON FOR DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Oatham said that Ms Barnes had a clear record under Rule 638(3)(g)(ii).

Mr Oatham referred to the Penalty Guide.

Ms Barnes did not comment.

REASON FOR PENALTY:

The Penalty Guide provides for a fine of $400 or 50% of the Rider’s percentage of any prizemoney won, whichever is the greater.  On this occasion $400 was higher than the percentage of the stake earned by her mount when finishing 4th.

CONCLUSIONS:

Ms Barnes was fined $400.
