FACTS

Following the running of Race 2, Information A17352 was filed with the Adjudicative Committee.

The Applicant Mr McNab, the Rider of the third-placed horse “DERRYAIRE”, protested against the first-placed horse “SPIRIT OF BEXLEY” (C Barnes), alleging interference near the 250m.

The Judge’s placings were:

1st        SPIRIT OF BEXLEY

2nd       EXPLOSIVE LASS

3rd       DERRYAIRE

The margins were ½ head, head

All films were shown without comment.

The Applicant Mr McNab was invited to state his case.

He said that he moved up outside Ms Barnes’ mount (SPIRIT OF BEXLEY) and that it ducked out for 3 or 4 strides and continued to lay out and inconvenienced his horse.

He said that if he got through (gap) he would have won easily.

Mr Auret, Trainer of third-placed horse “DERRYAIRE”, said that the inside horse ran out and that his horse had to take evasive action, that his line was taken and that there was ½ head and a head in it.

Ms Barnes, Rider of “SPIRIT OF BEXLEY” (1st) said that her horse changed legs and ducked out and then rolled in.  She said that Mr McNab’s horse had had plenty of time to get through and win.  She also thought that the outside horse shifted in.

Mr Osman, Trainer of “SPIRIT OF BEXLEY”, said that Mr McNab had not had to fully stop riding and that there had been plenty of time to get through the gap.

Mr Goodwin, Stipendiary Steward, said that there was movement from inside and out but that most was from the inside out.  He said it appeared that the winner was holding the third-placed horse most of the time.

REASONS FOR DECISION

The Adjudicative Committee found that some interference did take place near the 250m, when “SPIRIT OF BEXLEY” shifted out onto “DERRYAIRE”.  Shortly after this “DERRYAIRE”, when in clear racing room, did not take ground of “SPIRIT OF BEXLEY”.  It was only in the shadows of the post when “DERRYAIRE” was observed to make ground.

Albeit interference did take place, the Adjudicative Committee was not satisfied that “DERRYAIRE” would have beaten “SPIRIT OF BEXLEY” if such interference had not occurred.

CONCLUSION

Protest dismissed, with dividends and prize money to be paid on the Judge’s placings.
