SUMMARY OF FACTS:

Following Race 4 Ms Barnes was charged with striking her mount “LED ZED” 7 times with the whip prior to the 100m (5 is the limit).

EVIDENCE:

Mr Jones showed the film replays and showed where Ms Barnes had struck her mount 7 times prior to the 100m.

Ms Barnes agreed that it was 7 strikes.

REASON FOR DECISION:

As Ms Barnes admitted the breach it was found proved.

SUBMISSION FOR PENALTY:

Mr Jones said that Ms Barnes had a clear record and referred to the Penalty Guideline.

Ms Barnes said that she had a very good record.

REASON FOR PENALTY:

As this was the first time Ms Barnes had been charged with a whip breach, it was considered that the Penalty Guide starting point of a fine of $250 was a suitable penalty.

CONCLUSIONS:

Ms Barnes was fined $250.
