Evidence:

Ms Barnes has admitted a charge of careless riding in Race 6 in that she directed her mount YING RESOLUTE outwards when not sufficiently clear contacting and hampering HEY MICKEY near the 1100 metres.

Mr Oatham demonstrated on the videos that the Respondent was racing midfield near the 1100 metres when she shifted outwards into the line of HEY MICKEY. He stated that Ms Barnes had looked before shifting but was not her length and another clear. It was half a length at best. There was contact and HEY MICKEY was forced outwards.

Ms Barnes stated she had instructions to “get going” at the 1000 metres. She had looked, but she had misjudged her move. She acknowledged it was a bad error on her part. There had been no yelling and she had thought there was going to be room. She accepted it was only half a length.

Decision:

As Ms Barnes has admitted the breach, it is found to be proved.

Submissions for Penalty:

Mr Davidson produced the Respondent’s record which showed one breach in the past 12 months. This was a low-end breach at Riccarton on 10 March last where the penalty was a 4-day suspension. Mr Davidson described Ms Barnes as a busy National Rider. She has had 402 rides this season. The breach on this occasion, the Stewards believed, was towards mid-range as Ms Barnes had not desisted with her move but had kept coming.

Reasons for Penalty:

The breach is low to mid-range and a 6-day starting point is taken. Ms Barnes was not her length and another clear when she shifted outwards and she has come into contact with HEY MICKEY, which was shifted wider on the track. It was not a gradual move on her part. Ms Barnes’ record is very good for a busy National Rider with just one low-end breach this season. Giving credit for record and admission of the breach, the penalty is 5 days’ suspension.

Conclusion:

Ms Barnes is suspended from the end of riding today up to and including 3 August 2022.
