SUMMARY OF FACTS:

Following the running of Race 8, the NZB Insurance Pearl Series Race, Mr Jones presented an Information charging Mr Riddell with Careless Riding in breach of Rule 638(1)(d).

SUBMISSIONS:

It was contended by Mr Jones that upon entering the home straight, Mr Riddell angled his mount MADAME LE FAY into an outside gap, and allowed his mount to continue outward movement so as to buffet and crowd BORDEAUX ROSE, on his outside, which was forced onto JENNIE MORRIS, on its outside, with both affected horses being hampered passing the 250 metre point.  Mr Jones used the head on race film to illustrate the event.

Mr Riddell, although accepting that his riding was careless, submitted that MADAME LE FAY was racing ungenerously prior to the home turn, by shying and proving difficult to ride, and the horse’s manners contributed significantly to what had later occurred. He said that he may have been harshly treated to have been charged.

REASON FOR DECISION:

As Mr Riddell admitted the charge it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Jones submitted that the careless riding was at the low end.  He advised that over the past 12 months, this was Mr Riddell’s 5th careless riding breach.  He has received a variety of penalties.  He submitted that as this was a low range breach, a suspension of 5 days was appropriate.

Mr Riddell submitted that the breach was at the very low end and only arose because the horse was green and running about.  He said he had firm Rider engagements over the next 10 days.

REASON FOR PENALTY:

The Committee accepts that this was low end carelessness.  Although the horse was racing ungenerously before the incident, this required a Senior Rider such as Mr Riddell to exercise proper care when seeking a clear run by angling out at the top of the straight.

CONCLUSIONS:

Mr Riddell’s Licence is suspended for 5 days, the suspension to commence at the conclusion of racing on 11 December 2021 and to finish at the end of racing on 19 December 2021.
