Penalty: Jockey Jonathan Riddell is fined $500

Evidence:

Following the running of Race 10, Information No. A18136 was lodged alleging the Respondent, Class A Rider Mr J Riddell, struck his mount, MADAM LE FAY, six times prior to the 100-metre mark.

Mr Riddell confirmed to the Adjudicative Committee that he admitted the breach.

Rule 638(3)(g)(i) provides that a rider must not:

“Strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)

Using available film, Chief Stipendiary Steward Mr Oatham demonstrated that MADAM LE FAY was racing wide out on the track near the rear of the field. He pointed out that from the straight entrance to the 100-metre mark, Mr Riddell struck his mount six times.

Mr Riddell agreed with the number of strikes and had nothing further to add.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Mr Oatham presented the Respondent’s record which indicated two previous breaches of the Rule, namely, on 26 December 2022 and 13 November 2022.  Both were six strikes and resulted in $250 fines being imposed.

A penalty in line with current Guidelines was recommended.

Mr Riddell offered no submissions as to penalty.

Reasons for Penalty:

The Current Penalty Guidelines provide for a fine of $500 in the event of a third breach involving one additional strike. It was noted that the sixth strike was close to the 100-metre mark. There are no aggravating factors to consider. On that basis, the Adjudicative Committee found no reason to depart from the Guideline.

Conclusion:

The Respondent Mr Riddell was fined $500.
