SUMMARY OF FACTS

Jockey, Mr D  Bradley confirmed that he had breached Rule 638(3)(g)(i)  in that he had struck his mount 10 times prior to the 100 metre mark as shown on the film of the incident.

REASON FOR DECISION

The rule was clearly breached.

DECISION

As the breach was admitted it was found proved.

SUBMISSIONS ON PENALTY

While confirming the breach, Mr Bradley Bradley asked the Adjudicative committee to take into account he was trying the best for his owners  and that he only struck his mount on the shoulder.

Mr Coppins said this was Mr Bradley’s second breach of the Rule of four or more strikes of the whip. On 19 March he was fined $500 and asked that a period of suspension be imposed as per the Guidelines. He added that striking a horse on the shoulder could not be used as an excuse.

REASONS FOR PENALTY

As Mr Bradley had clearly breached the Rule for the second time a period of suspension was imposed.

Mr Bradley asked for any suspension to begin immediately and this was agreed to.

PENALTY

The period of suspension was one of 5 days beginning after the completion of racing today Thursday,  26 May and ending after the completion of racing Friday, 3 June.
