Evidence
Following the running of Race 4, the Respondent Mr D Bradley, admitted a charge alleging use of whip in consecutive strides over the concluding stages.
Rule 638(3)(g)(ii) provides that in a Flat Race a Rider must not:
(ii) strike a horse with a whip in consecutive strides at any stage of the race.
Using the available race films Stipendiary Steward Mr Goodwin demonstrated that the Respondent struck his mount 8 times consecutively over the concluding stages of the race.  Â
In response, by way of explanation, Mr Bradley said his “old -school” riding instincts kicked in when he burst to the front of the field and then became aware of 2 other horses closing in on him down the outside. He said the new Whip Rules had been in place for some time and he should have adapted to them by now. There was no excuse for his actions.
Decision
As Mr Bradley admitted the breach the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).
Submissions For Penalty
Mr Goodwin produced the Respondent’s record which was clear of previous whip breaches.
Stewards submitted a penalty commensurate with the NZTR Revised Penalty Guide for improper whip use (as of 1 September 2021).
Mr Bradley’s share of the stake was ($135).
Mr Bradley said he was resigned to receiving a period of suspension and advised that it could begin immediately. In response to a question from the Adjudicator Mr Bradley said he didn’t get a lot of rides and was very happy to get 3 per race day. In the last 12 months he has had 172 rides and for the current season 66 rides.
Reasons For Penalty
The Penalty Guide starting point for a breach of this nature is set out as follows:
6 or more consecutive strikes –1st offence – 5 national day suspension plus 50% of jockey stake.
After considering the film evidence and the submissions and having due regard for the number of consecutive strikes, the Adjudicative Committee determined a 5 day suspension and a $100 fine was appropriate. Mr Bradley’s whip use was far outside of the Guidelines and a poor reflection on the NZ Racing Industry. The Adjudicative Committee has taken into account that Mr Bradley’s suspension incorporates a premier day at Trentham.
Conclusion
Mr Bradley is suspended for 5 days from close of racing today January 8th 2022, until close of racing on Wednesday January 19th 2022.
In addition, a fine of $100 is imposed.
