SUMMARY OF FACTS

Jockey R Elliot admitted a charge of careless riding in that he angled his mount inwards near the 1200m making contact with MIDNIGHT SWEY (L Allpress) forcing that runner inwards off its rightful line of running.

Mr Elliot said that he understood the Rule, the charge and confirmed that he admitted the breach.

Film replays were shown with Mr Goodwin identifying where Mr Elliot allowed his mount to shift in and make contact with MIDNIGHT SWEY who was shifted in behind another runner.

Mr Elliot’s response was that he did shift a little too far as he was trying to get some cover and that the incident happened on a bad spot of the track, due to more water being on that area.

DECISION

As the charge was admitted along with the film evidence being compelling, the charge was found proved.

PENALTY SUBMISSIONS

Mr Goodwin placed the carelessness in the low-end and said Mr Elliot’s record showed that his last two breaches of the Rule were on:

10.07.2021    –           4 Days

13.05.2021    –           3 Days

Mr Elliot asked that any suspension start after 19 February.

REASONS FOR PENALTY

The film replays showed very clearly what had occurred.  Mr Elliot allowed his mount to shift inwards approximately one horse width too far, resulting in MIDNIGHT SWEY being forced off its line.

The Adjudicative Committee placed the carelessness exhibited by Mr Elliot to be in the low-range category.

Taking into account the Penalty Guide starting point, the record and the admission of the breach it was determined that a 4-Riding Day Suspension was a suitable penalty.

CONCLUSION

Mr Elliot’s Jockey’s Licence was suspended from the close of racing on 19 February through to the close of racing on 25 February 2022 (4 Days).
