Penalty: Jockey Bill Jacobson is suspended for 4 days
Miss Haley alleged that Mr Jacobson permitted his mount TAIHORO in Race 5, to shift outwards when not sufficiently clear of IT’S MARLIN, which was dictated outwards, causing crowding to EKSTATIQUE and EXPLODE near the 250 metres.
Mr Oatham demonstrated on the videos that as the field straightened for the run home, Mr Jacobson was racing midfield towards the centre of the track. He shifted out when not clear and Ms Riddell (IT’S MARLIN) was taken outwards and crowded EKSTATIQUE and EXPLODE as a consequence. Mr Moseley (EXPLODE) had to take a hold briefly.
Mr Jacobson said he was aware he was shifting ground. There was no yelling. TAIHORO had a tendency to run around. Mr Oatham agreed that TAIHORO did, but it was to a minor degree, and he did not believe it was a factor in this case.
Decision
As Mr Jacobson has admitted the breach, it is found to be proved.
Submissions as to Penalty
Miss Haley produced the Respondent’s record, which was very good, with no breaches of this Rule in the past 12 months. She described the breach as low end.
Mr Jacobson stated he accepted Miss Haley’s submissions and wished the suspension to start immediately.
Reasons for Penalty
Mr Jacobson has shifted ground outwards when not his length and another clear of Ms Riddell, who has been forced to shift outward. Mr Moseley was hampered and had to take hold of his mount. Ms Rogerson (EKSTATIQUE) also had to check her mount.
It is a low range breach and from a 5-day starting point, there is a one-day reduction for admission of the breach and Mr Jacobson’s very good record.
Conclusion
Mr Jacobson is suspended from the end of racing today, 23 May, up to and including 29 May 2025. This is 4 national days.
