Penalty: Jockey Bill Jacobson is suspended for 5 days

Evidence

Following the running of Race 6, the Respondent Class A Rider Bill Jacobson admitted a charge alleging excessive whip use prior to the 100 metres. It was alleged that Mr Jacobson struck his mount RUACH 8 times prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Mr Oatham demonstrated that the Respondent struck his mount 8 times from the straight entrance to the 100-metre mark. He pointed out that the final, 8th strike was just prior to the 100 metre mark.

In response, Mr Jacobson had nothing further to add.

Decision

As Mr Jacobson admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty

Mr Oatham produced the Respondent’s record, which indicated one previous breach within the rest period, which was for 8 strikes. This occurred in a Group Race on 27 April 2024 and resulted in a 6-day suspension and $300 fine.

Mr Oatham referred to the Penalty Guide, which indicated a 5-day suspension in circumstances where the number of strikes is 3 more than permitted.

Mr Jacobson sought a deferment to any proposed suspension, to after racing on 28 September 2024.

Reasons for Penalty

The Penalty Guide starting point for a breach of this nature is a 5-day suspension. There are no compelling reasons to deviate.  Accordingly, a 5-day suspension is imposed.

Conclusion

Mr Jacobson is suspended for 5 days, commencing after racing on 28/9/24 and concluding after racing on 06/10/24.
