Penalty: Jockey Wiremu Pinn is suspended for 5 days

Evidence:

Following the running of Race 1, the “Premier Horse Transport 1600”, Mr Jones presented an Information charging Mr W Pinn with careless riding in breach of Rule 638(1)(d).

The charge alleged that Mr Pinn permitted his mount, “TRUMP CARD” to shift inwards approaching the 100 metres point when insufficiently clear of “COPPERS” (Mr V Colgan), which was crowded and had to be checked and also hampered was “JAZZ WITH DRAGON” (Mr R Elliot).

Mr Pinn admitted the breach of the Rule.

The race films illustrated the inward movement of “TRUMP CARD” when struck twice with the whip, without any correction by Mr Pinn so as to contact “COPPERS”, which was forced onto Mr Elliot’s mount.

Decision:

As the breach was admitted, it was deemed proved.

Submissions for Penalty:

Mr Jones submitted that the degree of careless riding was low/mid range.  Mr Pinn has recently had a prolonged spell of riding in Australia when he had 4 careless riding offences from 6 July 2023 until 23 December 2023.  He was, and is, a very busy Rider with 78 mounts in New Zealand over the past 12 months.

Mr Pinn said that he accepted responsibility as he believed he should have struck his mount once only, and not twice as he did, but the horse laid inwards.  He said he had commitments up until Saturday 27 January 2024.

Reasons for Penalty:

A suspension of 5 National Riding days was an appropriate sanction given the Penalty Guide starting point.  The Adjudicative Committee did not consider there to be significant aggravating or mitigating factors to adjust that level.

Conclusion:

Accordingly, Mr Pinn’s Licence to ride is suspended for 5 National Riding Days, from the end of racing on 27 January 2024, until the end of racing on 8 February 2024.
