Evidence:
Following the running of Race No. 3, the “Vandyks Furnishings 3YO”,  Mr Williamson presented an Information charging Apprentice Jockey, W Pinn with careless riding in breach of Rule 638(1)(d).

It was contended that Mr. Pinn permitted his mount “MERCURIAL” to shift in when insufficiently cleared of “IFFSHECAN” ridden by Mr. M Cameron, which was hampered near the 850 metre point.

Mr Pinn assisted by Mr Harris admitted the breach.

Stipendiary Steward, Ms Selvakumaran demonstrated from the Race films (head and side on) that “MERCURIAL” was moving towards a prominent position, and on the outside of ”IFFSHECAN”.  Mr Pinn is seen to look  2-3 times to his inside before crossing in front of Mr Cameron’s mount and causing it to be restrained.  The carelessness as low end.

Mr Pinn said that he was 2-3 wide as he moved forward to be outside “IFFSHECAN”.  He said that Mr Cameron said for him to “go forward”.  He did this but accepted that he was not the required distance clear. He said that “IFFSHECAN” was overracing which contributed to its being hampered.

Decision:
As the breach was admitted it was deemed proved

Penalty Submissions:
Mr Williamson advised that for careless riding offences, Mr. Pinn has a good record over the past 7 months having been suspended on one occasion.

Reason for Penalty:
This was a low range breach of the careless riding Rule, for which the Penalty Guide provides a starting point of a 5 national riding day suspension.  The Committee allows a deduction of 1 day to reflect the mitigating circumstances of the breach, and Mr. Pinn’s record for the type of breach.

Penalty
Accordingly, Mr Pinn (who has committed riding engagements over the next 7 days) is suspended for 4 National Riding days, to commence at the conclusion of racing on 21 May 2022 and to end at the conclusion of racing on 27 May 2022.
