Mr Pinn has admitted that  he struck his mount CALLISSIDENT  six times prior to the 100 metres.

Mr Jones demonstrated on the video that CALLISSIDENT was making a run near the rail. The horse moved towards the middle of the track and, at this time, Mr Pinn struck the horse six times with the whip prior to the 100 metres.

Both Mr Pinn and Mr Harris agreed with this count.

As Mr Pinn has admitted the breach, it is found to be proved.

Mr Jones produced the Respondent’s record which showed a previous breach of this Rule on 12 February last. Mr Jones submitted that a penalty in accordance with the Penalty Guidelines should be imposed. Both Mr Pinn and Mr Harris agreed this was appropriate.

Mr Pinn has shifted ground outwards gradually in the home straight, when clear, no doubt looking for better ground. In so doing, he has struck CALLISSIDENT six times prior to the 100 metres mark. The NZTR Revised Penalty Guidelines provide a penalty of a fine of $250 for a second breach where there is one additional strike.

Mr Pinn is fined the sum of $250.
