Penalty: Jockey Ryan Elliot suspended for 4 riding days and fined $250

EVIDENCE:

The Stewards charged Mr Elliot with a breach of Rule 638(1)(d) in that Ryan Elliot (BLACK FOREST) allowed his mount to shift out when not clear of GAELIC SPIRIT (L Hemi) which was checked near the 350 metres.

Video evidence was provided with Mr Elliot identifying his mount.

The field entered the home straight with INVISIBLE SPIRIT (Ms C O’Beirne) in front. To his outside were GAELILC SPIRIT (Ms L Hemi) and KINGSFISHER LAD (Ms S Macnab).  At this point BLACK FOREST was positioned behind the leading horse. Upon straightening Mr Elliot looked to improve. When doing so his mount was insufficiently clear of GAELIC SPIRIT who was hampered losing momentum.

When asked for comment Mr Elliot conveyed that in his view he was not entirely responsible for the interference caused as INVISIBILE SPIRIT had ‘changed leg’ whilst KINGFISHER LAD had rolled in under pressure.

REASON FOR DECISION:

Mr Elliot admitted the breach and it is found proved.

SUBMISSION FOR PENALTY:

Mr Williamson referenced Mr Elliot’s commendable record noting he was last suspended on 13 May 2021 on a ‘low range’ careless riding charge.  His previous careless riding infringement was 26 September 2019.

Mr Williamson did not specifically identify where he considered the infringement ‘sat’ although he did remain of the view that of the interference caused (75%) was generated by Mr Elliot.

Mr Elliot sought deferment to satisfy existing riding commitments.

REASON FOR PENALTY:

The breach is considered to be at, or just above low range. Current Guidelines provide a starting point for a low range careless riding breach at a $250 fine and 4-day suspension. On balance it is considered that this penalty is appropriate. In setting penalty, we recognise Mr Elliot’s riding record and ready admission.  We also accept the assertion that not all interference caused was as a result of his actions alone.

CONCLUSIONS:

Mr Elliott is suspended for 4 national riding days taking effect from the conclusion of racing on July 17 2021, up to and including 25 July 2021. In addition, a fine of $250 is imposed.
