EVIDENCE:

Following the running of Race 4, Mr J Parkes admitted a charge alleging he struck his  mount in consecutive strides over the concluding stages.

Rule 638(3)(g)(ii) provides that in a Flat Race a Rider must not:

(ii) strike a horse with a whip in consecutive strides at any stage of the race.

Using the head-on race films Stipendiary Steward Mr Goodwin demonstrated that Mr Parkes struck his mount 3 times consecutively over the last 100m of the race. 

In response, by way of explanation, Mr Parkes said this was his first day back riding after a few months away and the Whip Guidelines had changed over that time.

Decision

As Mr Parkes admitted the breach the Adjudicative Committee found the breach proved.

Submissions For Penalty

Mr Goodwin produced the Respondent’s record which indicated no charges relating to this Rule in the last 6 months.

Mr Parkes said he had spoken to other Riders before the races today and was aware the Whip-Use Guidelines had changed however it  might take him a while to get used to the new Regulations.

Reasons For Penalty

The Penalty Guide starting point for a 1st offence of 3 consecutive strikes is the greater of a $150 fine or 50% of Jockey stake. Mr Parkes ran third in the race and his share of the stake was $90.

After considering all submissions and having due regard for the number of consecutive strikes the Adjudicative Committee determined there were no compelling reasons to depart from the starting point set out in the Penalty Guide.

On that basis Mr Parkes is fined $150.
