BACKGROUND:

Following the running of Race 1, the Respondent, Mr J Parkes, admitted a charge alleging that he used his whip action, that raises the Rider’s arm above shoulder height, on his mount CHASE.

Rule 638(3)(f)(ii) provides:

Without limiting the generality of subrule 638(3), in a Flat Race . . . A Rider must not use his / her whip:

(ii)  using an action that raises the Rider’s arm above shoulder height.

EVIDENCE:

Video replays of the final straight were played and Ms Algar showed 5 occasions where Mr Parkes used the whip above his shoulder.  She said the Stewards were satisfied that he rode in a manner within all other whip parameters.

Mr Parkes agreed with the Stewards’ assessment of the breach, and had nothing further to add.

DECISION:

As the Respondent admitted the breach, the charge was found to be proved.

SUBMISSIONS FOR PENALTY:

Ms Algar said that Mr Parkes had a clear record under this Rule, but had received a recent warning for having his arm too high. The Stewards’ submission was for a fine in line with the Penalty Guidelines.

REASONS FOR PENALTY:

The Adjudicative Committee considered all submissions. Aggravating factors could be the number of times Mr Parkes used his whip above shoulder height (5x) and the fact he won the race. In mitigation, is his clear record and admission of the breach. Balancing all factors, Mr Parkes is fined the sum of $250.

CONCLUSION:

The Respondent, Rider Mr J Parkes, is fined $250.
