SUMMARY OF FACTS:

Following the running of Race 1 an Information was lodged alleging Mr Parkes … used his whip excessively prior to the 100 metres (ie 6 times).  

At the outset of the hearing Mr Parkes confirmed that he understood the Rule and admitted the breach.

Film of the race was presented. It was identified that Mr Parkes struck his mount on 6 occasions from the top of the straight and the 100 metre mark. SMART ATTIRE won the race.

Mr Parkes did not offer specific comment other than suggesting some of the strikes were of minimal force.

REASON FOR DECISION:

Mr Parkes admitted the breach therefore the charge was deemed proved.

SUBMISSION FOR PENALTY:

Mr Goodwin presented Mr Parkes’ record. This represented Mr Parkes’ second whip offence within the last six months. His previous breach was on 11th December 2021 with same resulting in a fine of $150.  Penalty in line with the current Guidelines was recommended.

REASON FOR PENALTY:

The Penalty Guideline starting point for 2nd offence whip breach is the greater of $500 or 50% of Jockey share of the stake (calculated to be $168). Penalty in line with the Guideline is deemed appropriate.

CONCLUSIONS:

Mr Parkes is fined a sum of $500.
