SUMMARY OF FACTS:
The Information alleged a breach of Rule 638(3)(g)(i) in that R Elliot struck his mount TARWYN with the whip six times prior to the 100m.
At the outset of the hearing, Mr Elliot confirmed he understood the Rule and admitted the breach.
Mr Oatham played the head-on video to show where Mr Elliot hit his mount 6 times with the 6th strike being only 2 strides short of the 100m. Mr Elliot said the breach was simply a misjudgment.
REASON FOR DECISION:
Mr Elliot admitted the breach therefore the charge was deemed proved.
SUBMISSION FOR PENALTY:
Mr Oatham said this was Mr Elliot’s third breach of the Whip Rules in the last 6 months.

Mr Elliot advised of riding commitments through until tomorrow October 17th.
REASON FOR PENALTY:
The Committee had regard to the revised Penalty Guidelines of 1st September 2021. The starting point for a fourth offence is 5+ national days plus 50% of Jockey share of stake. Mr Elliot was only 1 strike over the five allowed, gained no advantage, and did not finish in a dividend-bearing position. Taking into account all submissions an appropriate penalty was six days.
CONCLUSIONS:
Mr Elliot is suspended from the close of racing on Sunday October 17th up to and including racing on Monday October 25th.
