Penalty: Jockey Samantha Wynne is suspended for 7 Days

Evidence:

Following the running of Race 1, the Respondent Class A Rider Samantha Wynne admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d).  The Information alleged that as the Rider of EULOGY SHOW, allowed her mount to shift inwards when not clear of HEY MICKEY and MR RAFIKI, which were both crowded. 

The Respondent acknowledged she understood the Rule and confirmed her admission of the breach.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using the available race films, Stipendiary Steward Veronica Algar demonstrated the incident and identified the horses and Riders concerned.

Ms Algar said that approaching the 1800 metre mark, the Respondent has shifted ground inwards when not sufficiently clear of HEY MICKEY and MR RAFIKI, crowding both horses over a period and as a result, both had to take evasive action and check.

In response, the Respondent stated that she was sure she had cleared HEY MICKEY when she improved past when attempting to improve to the lead position. Miss Wynne added that HEY MICKEY was tending to over race, which she believed contributed to the incident.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.

Submission for Penalty:

Mr Oatham produced the Respondent, Miss Wynne’s riding record which indicated 3 previous breaches under the Careless Riding Rule in the last 12 months, namely 6 November 2021 – Riccarton (7 days), 7 May 2022 – Riccarton (6 days), and 1 September 2022 – Riccarton (5 days).

Mr Oatham said Stewards assessed the level of carelessness to be in the mid-range.

The Respondent did not seek a deferment to any proposed suspension.

In terms of any proposed penalty, the Respondent’s only submission was that she wanted any suspension to begin as soon as possible.

Reasons for Penalty:

After considering all submissions, the Adjudicative Committee determined the Respondent’s carelessness to be in the mid range, and accordingly adopted a 7-day (suspension) as the starting point.

The available films clearly established that the Respondent was not clear of the two inside runners when attempting to improve to the lead position.

The Respondent’s riding record is treated as an aggravating factor and a 1-day increase was applied to the 7-day starting point. For her admission of the breach a discount was applied. That discount we set at 1 day.

Conclusion:

Miss Wynne’s licence to ride in races is suspended for a period of 7 days, commencing after racing today 17 September 2022 and concluding after racing on 28 September 2022.
