Outcome: Proved

Penalty: Jockey Kavish Chowdhoory is suspended for 5 days

Evidence:

Following the running of Race 6, the Respondent Class A Rider Mr Kavish Chowdhoory admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d).  The Information alleged that he angled his mount MANUKA RUSH outwards passing the 200m, crowding and checking RECONVENE (M Hudson).

Mr Chowdhoory confirmed his admission of the breach.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using the available race films, Stipendiary Steward Ms Selvakumaran demonstrated the incident and identified the horses and Riders involved. The films showed Mr Chowdhoory held up behind the leaders, near the 200-metre mark. He then angled outwards in search of clear running, placing RECONVENE in restricted room. Mr Chowdhoory continued to shift outwards, resulting in RECONVENE being checked, before correcting his line by shifting back inwards.

In response, Mr Chowdhoory stated that he was unaware Ms Hudson was to his outside, believing he was the last runner in the field. He added that the strong wind conditions prevented him from hearing any calls.

Decision:

As Mr Chowdhoory admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Ms Fisher produced Mr Chowdhoory’s riding record, which showed one previous breach of the Careless Riding Rule within the past 12 months, occurring at Riccarton in August 2025, for which he received a 6-day suspension. Mr Chowdhoory has had 294 rides over that period, noting a significant absence due to injury.

Stewards assessed the level of carelessness to be below mid-range.

Mr Chowdhoory advised of riding engagements through to 17 May at Hawera and sought a deferment of any suspension.

Reasons for Penalty:

After considering all submissions, the Adjudicative Committee assessed Mr Chowdhoory’s carelessness as just above the low range and adopted a starting point of a 6-day suspension, in accordance with the NZTR Penalty Guide.

The race films showed that Mr Chowdhoory was held up for a run and, in attempting to improve his position, angled outwards with some urgency. In doing so, he shifted into the line of RECONVENE, causing that runner to be checked. The Adjudicative Committee accepted that this was an error of judgement when under pressure, and that the strong wind conditions perhaps reduced his awareness of other Riders.

In determining penalty, the Adjudicative Committee took into account Mr Chowdhoory’s admission of the breach and his overall good record. A one-day reduction was applied on that basis.

Balancing all factors, a suspension of 5 days was considered appropriate and proportionate.

Conclusion:

Mr Chowdhoory’s request for a deferment is granted and his Licence to ride in races is suspended for a period of 5 days, commencing after racing on Sunday May 17 and concluding after racing on Sunday May 24, 2026.
