EVIDENCE:

Following the running of Race 8, the “NZCIS WELLINGTON CUP PACKAGES NOW ON SALE SPRINT”, Ms Selvakumaran presented an Information charging Mr K Chowdhoory, the Rider of “BOLD BELLE” with a breach of the Whip Rule 638(3)(g)(i) in that he struck his mount on 9 occasions prior to the 100 metre mark.

Mr Chowdhoory admitted the breach of the Rule.

The race films, as explained by Ms Jillings, illustrated that “BOLD BELLE”, when in 2nd place at about the 300 metre point, and appearing to have been mastered by “I’M ALL IN”, rallied under a vigorous ride when struck 9 times by Mr Chowdhoory prior to the 100 metre mark, to get up to win narrowly.

DECISION:

As the charge was admitted it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

The Informant advised that Mr Chowdhoory had a clear record for any breaches of the Whip Rules over the past 6 months.  She sought a term of suspension in accordance with the NZTR Penalty Guide.

Mr Chowdhoory acknowledged that he had to be suspended and later accepted that he did not require any deferment after racing at Waverley on 19 October 2025.

REASONS FOR PENALTY:

As was said in an earlier case relating to another Rider, it is “cheating” to try to win a race by breaking the Rules of Racing.

On this occasion, the Adjudicative Committee deemed that a suspension was the appropriate penalty.

CONCLUSION:

Accordingly, Mr Chowdhoory’s Licence to ride was suspended for 5 National Riding Days, to commence at the conclusion of racing on 19 October 2025 and to end at the conclusion of racing on 26 October 2025.
