Outcome: Proved
Penalty: Class A Rider Kavish Chowdhoory is suspended for 5 days
Evidence:
Following the running of Race 7, the Respondent, Mr Kavish Chowdhoory, was charged with careless riding pursuant to Rule 638(1)(d). The Information alleged that as the Rider of DIPLOMATIC, “he permitted his mount, to shift inward when not sufficiently clear of TRAFALGAR (G Grylls), which was forced onwards onto GLANCE (J Taplin), which was checked at the 200 metre point.
The Respondent acknowledged he understood the Rule and confirmed his admission of the breach.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.
Using the available race films, Deputy Chief Stipendiary Steward, Mr B Jones, demonstrated the incident and identified the horses and Riders concerned.
Mr Jones said that approaching the 200 metre mark, the Respondent has shifted ground onto TRAFALGAR (Mr Grylls) when insufficiently clear, which was in turn dictated onto GLANCE (Mr Taplin), which was checked.
Mr Chowdhoory accepted the Stewards’ interpretation
Decision:
As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.
Submissions for Penalty:
Mr Oatham produced the Respondent’s riding record, which indicated only 1 previous breach under the Careless Riding Rule in the last 12 months:
10 May – 5 day suspension
The Respondent has had 271 rides in the past 12 months. The Stewards considered this to be a good record.
Mr Oatham said the Stewards assessed the level of carelessness to be in the low to mid-range, which had a starting point under the Penalty Guide of 6 days suspension.
The Respondent sought a deferment to any proposed suspension until after racing at Hawera on 4 November, to fulfill existing engagements.
Reasons for Penalty:
After considering all submissions, the Adjudicative Committee determined the Respondent’s carelessness to be in the low to mid range and adopted a 6-day suspension as the starting point. This complies with the NZTR Penalty Guide.
The Respondent’s riding record and admission of the breach was treated as a mitigating factor. Accordingly, a 1-day reduction was applied to the 6–day starting point.
Conclusion:
The Respondent’s request for a deferment is granted and his Licence to ride in races is suspended for a period of 5 days, commencing after racing on Wednesday 4 November 2026 and concluding after racing on Wednesday 11 November 2026 (5 national riding days).
