Penalty: Jockey Krishna Mudhoo is fined $200
Mr Davidson alleged that Mr Mudhoo was unable to make the weight for QUISIERA in Race 7 and was replaced.
Mr Davidson said the Respondent was carded to ride QUISIERA at 55kg, but had come to the Stewards during the course of the meeting and stated he was unable to make the weight, as he was over 1kg above 55kg. Mr Mudhoo was replaced by Ms Hudson. The race was the Dunedin Guineas, a Listed Race, and he believed a minor infringement notice was not appropriate in these circumstances.
Mr Mudhoo explained that he had tried hard both before and during the meeting to lose the weight in the sauna. He had not succeeded. When questioned by the Adjudicative Committee, he said that he could “normally do 55 quite easily”.
Decision
As Mr Mudhoo has admitted the breach, it is found to be proved.
Submissions as to Penalty
Mr Davidson said the usual infringement penalty was $100 and he believed a $200 fine was appropriate.
Mr Mudhoo did not demur.
Reasons for Penalty
Mr Mudhoo has failed to make the weight in a Listed Race. His attempts to meet the weight are noted. There would have been members of the betting public who had placed bets on QUISIERA in the belief that Mr Mudhoo would ride the horse. Also, the connections no longer had the services of their preferred Jockey.
Conclusion
Mr Mudhoo is fined the sum of $200.
