EVIDENCE:

Following the running of Race 7, an Information was presented by Stipendiary Steward Ms Veronica Algar alleging a breach of Rule 638(1)(d) by Jockey Mr Krishna Mudhoo.

Mr Mudhoo stated he was conversant with the Rule, understood the charge and he confirmed he admitted the breach.

Ms Algar had Mr Oatham identify Mr Mudhoo (FOREVER BABE), who was drawn in the outside gate for the 1200m race. Mr Oatham pointed to Mr Mudhoo begin quickly and as he shifted inwards, was not sufficiently clear of TENGIZ (L Douglas), who was forced to check approaching the 1000m mark.

Mr Mudhoo said he misjudged his manoeuvre.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Ms Algar stated that Mr Mudhoo has, with his breach in Race 4 today, had 5 previous breaches of this Rule in the past 12 months, which the Stewards see as a concerning factor.

Ms Algar said the Stewards see this breach as low level and would leave it to the Adjudicative Committee to arrive at an appropriate Penalty.

Mr Mudhoo made no submissions.

REASONS FOR PENALTY:

The Thoroughbred Penalty Guidelines provide a 5-day suspension for a low-level breach of the Rule, which this is.

Mr Mudhoo’s record is now an aggravating factor, which requires an uplift in Penalty. The Adjudicative Committee sets this uplift at one day, but Mr Mudhoo’s admission determines that a 5-day suspension is an appropriate Penalty in this case.

CONCLUSION:

Jockey Mr Krishna Mudhoo’s Licence to ride in races is suspended from the conclusion of racing on 26 May 2023, up to and including racing on 3 June 2023.
