EVIDENCE:

Following the running of Race 4, an Information was presented by Stipendiary Steward Ms Veronica Algar alleging a breach of Rule 638(1)(d) by Jockey Mr Krishna Mudhoo.

Mr Mudhoo stated he was conversant with the Rule, understood the charge and he confirmed he admitted the breach.

Ms Algar had Mr Oatham identify Mr Mudhoo (HIGHLAND FLING), racing off the rail and in behind the leaders, entering the final straight. Mr Oatham pointed to WAY ABOVE (T Moseley), TAKE THAT (L Douglas), SASSY CHOUXS (J Fawcett), and FATHER LENIHAN (K Williams), who were, in that order, racing to the outside of Mr Mudhoo.

Mr Oatham demonstrated, at the 400m, Mr Mudhoo shift outwards, when not clear, contacting WAY ABOVE and starting a concertina effect on the aforementioned 4 horses, resulting in FATHER LENIHAN having to be checked.

Mr Mudhoo said the film tells the story and he had nothing to add to it.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Ms Algar stated that Mr Mudhoo has had 4 previous breaches of this Rule in the past 12 months.

16 June 2022, Riccarton – mid-range breach, suspended 6 days.

10 August 2022, Riccarton – low-mid, 5 days.

30 October 2022, Ashburton – low, 4 days.

25 November 2022, Cromwell – low, 5 days.

Ms Algar said the Stewards see this breach as low to mid-level and would leave it to the Adjudicative Committee to arrive at an appropriate Penalty.

Mr Mudhoo made no submissions on Penalty but asked to start any suspension immediately.

REASONS FOR PENALTY:

The Thoroughbred Penalty Guidelines provide a 6-day suspension for a low to mid-level breach of the Rule which the Adjudicative Committee find this is.

Mr Mudhoo has not breached the Rule for 6 months, a good performance given Mr Mudhoo is a very busy Rider and assess his record as neutral. The Adjudicative Committee appreciates Mr Mudhoo’s frank admission and professional conduct at the hearing and in considering all factors, determines that a 5-day suspension is an appropriate Penalty in this case.

CONCLUSION:

Jockey Mr Krishna Mudhoo’s Licence to ride in races is suspended from the conclusion of racing today, up to and including racing on 26 May 2023.
