EVIDENCE:

After Race 5, the Listed HS Dyke Wanganui Guineas, Mr Goodwin presented an Information charging Mr Pinn with a breach of Whip Rule 638(3)(f)(ii), alleging he used his whip arm above shoulder height on TO BRAVERY BORN twice in the home straight. Mr Pinn admitted the charge and race film evidence confirmed the Rule was breached on two occasions.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Goodwin noted that Mr Pinn has a clear record under this Rule and therefore would normally receive a warning. However, Penalty Guidelines specify that breaches in black-type races cannot be met with a warning. Mr Pinn explained he had travelled four hours for this single ride and felt frustrated, as he expected the horse to perform better.

REASONS FOR PENALTY:

While such a breach would typically result in a warning for Mr Pinn, the Listed status of the race necessitated a formal charge. TO BRAVERY BORN finished sixth in the race. A fine of $250 was considered appropriate.

CONCLUSION:

Mr Pinn is fined $250 for this breach.
