Background:

Following the running of Race 5, the ‘Tauranga Hardware & Plumbing 1200’, an Information was lodged alleging a breach of Rule 638(3)(f)(ii). Details are as follows:

‘in that he used his whip with an action which raised arm above shoulder height on one occasion when riding CHARMROSE’.

Rule 638(3)(f)(ii) provides:

(f) A Rider must not use his or her whip:

(ii) using an action that raises the Rider’s arm above shoulder height.

The Respondent confirmed to the Adjudicative Committee that he admitted the breach.

Evidence:

Using available film, Stewards identified the incident. On entering the straight, CHARMROSE was against the fence and leading the field. The Respondent had his whip in the right hand. The horse began to drift away from the fence. In response, in an endeavor to straighten his mount, the Respondent is seen to change his whip to left hand and strike with an action beginning from above shoulder height. The horse is then struck on 1 further occasion, with this action being in a compliant manner. CHARMROSE won the race. Mr Pinn agreed with Steward interpretation and readily admitted his error.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

The Adjudicative Committee was referred to the current Penalty Guide. This is the Respondent’s 3rd breach of the Rule within the last six months, the previous being Wanganui JC on 30/8/2025 – $250 fine and R Tauranga on 1/11/2025 – $300 fine.

Reasons for Penalty:

Available film clearly identifies the breach. The current Penalty Guide provides for a $250 fine for a first offence breach under this particular Rule. Given circumstance, an uplift in fine over the previous sanction ie: $300 fine, is required.  A fine of $400 is deemed to be appropriate.

Conclusion:

Mr Pinn is fined a sum of $400.
