BACKGROUND:
Following the running of Race 6, Class A Rider, Mr W Pinn, admitted a charge of careless riding in that, as the Rider of ZIGGY STARDUST, he permitted his mount to shift outwards when not sufficiently clear of MISS FLADGATE ridden by Mr G Rooke, which was checked passing the 200 metre point.
Rule 638(1) provides:
(d) A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be:
(d) careless
EVIDENCE:
Senior Stipendiary Steward, Mr B Jones, requested Stipendiary Steward Mr D Morris show video replays illustrating the incident. Mr Morris identified from the video, that with approximately 200 metres to run, Mr Pinn on ZIGGY STARDUST, moved out into the line of Mr Rooke on MISS FLADGATE, when not sufficiently clear. At the time of the incident, Mr Pinn was only three quarters of a length in front of Mr Rooke’s mount. Mr Pinn’s mount shifted out 3 to 4 horse widths.
Mr Pinn said that he agreed with the Steward’s interpretation of the incident.
DECISION:
The charge having been admitted, it is deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Jones said that Mr Pinn has three careless riding breaches on his record in the past 12 months:
19 October 2024 – suspended 8 days;
28 September 2024 – suspended 7 days; and
7 July 2024 – causing fall, suspended 4 weeks.
The Steward’s viewed the breach to be in the low range, with a starting point of 5 days.
Mr Jones advised that Mr Pinn has had 371 rides in the past twelve months, so his record was considered as neutral. In his favour, he had admitted the charge which, in the Steward’s view, along with his neutral riding record, deserved consideration for a discount.
Mr Pinn told the Adjudicative Committee that he wished to take advantage of a deferment until after racing at Te Rapa on Saturday 26 April.
REASONS FOR PENALTY:
The Adjudicative Committee considered the breach to be in the low range. The starting point for a low range breach under the RIB Thoroughbred Racing Penalty Guide (March 2024) is a 5-day suspension. An appropriate starting point is, therefore, a suspension of 5 days. Mr Pinn is entitled to a discount from that starting point, for his admission of the breach. The Adjudicative Committee fixes the appropriate discount at 1 day. Mr Pinn’s Licence to ride is therefore suspended for 4 days.
CONCLUSION:
Mr Pinn’s application for a deferment of suspension is granted. His Licence to ride in races is therefore suspended from after the close of racing on Saturday 26 April, up to and including racing on Saturday 3 May 2025 – 4 national riding days.
