Penalty: Jockey Kavish Chowdhoory is fined $500

Evidence:

Following the running of Race 2, the “Barber Commercial 1400”, Mr Dooley presented an Information charging Mr Chowdhoory with a breach of Rule 638(3)(g)(i), the Whip Rule, in that he “used his whip 8 times prior to the 100 metre mark to his mount REPROBATE”.

Mr Chowdhoory admitted the charge.

The race films depicted “REPROBATE” commencing a run wide out on the track upon the field entering the home straight.  When challenging from the 450m mark, Mr Chowdhoory rode vigorously and before the 100 metre mark, had struck his horse with the whip 8 times.  “REPROBATE” finished well, to run into third place.

Mr Chowdhoory commented that because of the length of the Trentham straight (450 metres) and the commencement of striking with the whip, commenced at that mark, the distance of 350 metres to the 100 metre mark misled his judgment.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Dooley advised that Mr Chowdhoory had a clean record for breaches of the Whip Rule and there were no circumstances that required a departure from the NZTR Guide (fine of $500).

Reasons for Penalty:

In keeping with the Penalty Guide, the Adjudicative Committee deemed a fine was an appropriate sanction on this occasion.

Conclusion:

Accordingly, Mr Chowdhoory was fined $500.
