Hearing Date:

Hearing Location:
Dunedin
Outcome: Proved
Penalty: Jockey Kavish Chowdhoory is suspended for 4 days
Mr Davidson alleged that in Race 4, Mr Chowdhoory allowed his mount GOLLYMOLLY to shift inwards throughout the run home and passing the 150 metres dictated I’M NO PRINCESS into BEAVER FEVER which was crowded.
Miss Haley demonstrated on the videos that the Respondent who was racing in the centre of the track, allowed his mount to shift inwards in the home straight. Mr Subramaniam’s mount I’M NO PRINCESS, who was racing to his inside, shifted away from GOLLYMOLLY, but Mr Chowdhoory kept coming and Mr Callaway (BEAVER FEVER) who was to the inside of Mr Subramaniam and on the rail, had to take hold of his mount.
Mr Chowdhoory stated that he knew Mr Subramaniam was there and he thought he was clear when he shifted, but he now recognised that he was not. He was not aware that he had checked Mr Callaway.
DecisionÂ
As Mr Chowdhoory has admitted the breach, it is found to be proved.
Submissions as to Penalty
Mr Davidson produced the Respondent’s record, which evidenced 5 breaches of this Rule in the past 12 months. One was just within the 12-month period. Mr Davidson said Mr Chowdhoory was a busy Rider who was currently based in the Central Districts, having had 322 rides this season on both Islands. He described the breach as the low range.
Mr Chowdhoory stated he accepted Mr Davidson’s submissions and wished the suspension to start after racing at Hastings on 6 July.
Reasons for Penalty
Mr Chowdhoory has shifted ground inwards when not his length and another clear of an inside runner, which has resulted in the horse to the inside of that runner being checked.
It is a low range breach and from a 5-day starting point, there is a one-day reduction for admission. Mr Chowdhoory’s record is not viewed as an aggravating factor when consideration is given to the number of rides he has had in the past 12 months and the fact that the last 3 breaches were all low range.
Conclusion
Mr Chowdhoory is suspended from the end of racing on 6 July, up to and including 12 July 2024. This is 4 national riding days.
