Penalty: Jockey Ashvin Goindasamy is suspended for 5 days

Mr Oatham alleged that Mr Goindasamy rode carelessly in Race 7 in that he permitted his mount BURNVUE to shift inwards when not sufficiently clear of MIDNIGHT RUNNER, which was checked near the 150 metres.

Miss Haley demonstrated on the videos, that Mr Goindasamy when not his length and another clear, shifted inwards and while he did straighten his mount, this was not quick enough to avoid MIDNIGHT RUNNER being checked. Mr Goindasamy had taken corrective action too late.

Mr Goindasamy said he had ridden BURNVUE in the past and was aware it could lug in. He had given the horse a couple and was too late in straightening his mount. The horse had never previously shifted ground like it did after his second strike with the whip.

Decision

As Mr Goindasamy has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Oatham produced Mr Goindasamy’s record. This evidenced 2 breaches in the past 12 months. Both were early this year. Mr Goindasamy has had 323 rides in the past 12 months. The Stewards believed the breach was low to mid-range. BURNVUE had not been the easiest ride, but the Respondent had given the horse 2 strikes once it had started moving in.

Mr Goindasamy requested a deferment of penalty until after the Timaru Meeting on 9 June.

Reasons for Penalty

Mr Goindasamy has shifted inwards when not his length and another clear. The breach is accentuated by the fact there were 2 strikes with the whip after the horse had started to shift ground, with the second being after the horse had moved some distance. It is a mid to low-range breach. A starting point of 6 days is appropriate. When regard is had to record and admission of the breach, a one day discount is appropriate.

Conclusion

Mr Goindasamy’s Licence to ride in races is suspended from the end of racing on 9 June, up until the conclusion of racing on 20 June 2024. This is 5 national riding days.
