Penalty: Class A Rider Ashvin Goindasamy is suspended for 5 days

Miss Haley alleged that Mr Goindasamy permitted his mount EXPRESS COUP in Race 8 to shift ground inwards when not sufficiently clear of FAKEITTILLUMAKEIT, which was checked near the 1000 metres.

Mr Oatham demonstrated on the videos that shortly after the start, Mr Goindasamy (EXPRESS COUP) came across when not clear of Mr Mudhoo, who had to check his mount severely for a number of strides. He added that FAKEITTILLUMAKEIT was racing keenly at the time and took a bit of time to come back to Mr Mudhoo. Mr Goindasamy was only a length clear.

Mr Goindasamy said he was not aware that Mr Mudhoo was there, and he would have taken more care if he had known. He added that EXPRESS COUP is not the easiest horse to ride, and he was wanting to stay quiet. In response to questioning, he said he was aware he was shifting in and had simultaneously restrained EXPRESS COUP to get more control of the horse.

Decision 

As Mr Goindasamy has admitted the breach, it is found to be proved.

Submissions as to Penalty

Miss Haley produced the Respondent’s record, which evidenced 1 breach of this Rule in the past 6 months on 1 January. She said it was an error of judgment by Mr Goindasamy and agreed EXPRESS COUP was giving him some difficulty. She described the breach as low to mid-range.

Mr Goindasamy did not disagree with Miss Haley and stated he wished the suspension to start after Riccarton on the 24th.

Reasons for Penalty

A six-day starting point is appropriate for the breach. This takes into account that EXPRESS COUP was giving Mr Goindasamy some difficulty at the time. There is a one-day reduction for the fact that Mr Goindasamy is a busy Rider with a good record and has admitted the breach.

Conclusion

Mr Goindasamy is suspended from the end of racing on 24 July, up to and including 2 August 2025. This is 5 national racing days.
