Penalty: Jockey Ashvin Goindasamy is fined $250

Mr Davidson alleged that in Race 9, Mr Goindasamy struck his mount HEART OF ALLADIN 6 times prior to the 100 metres, with another 5 strikes inside the final 100 metres.

Miss Haley demonstrated on the videos, that the Respondent was racing near the rear of the field as the horses rounded the home bend. He shifted wider on the track and made up good ground. Mr Davidson stated that Mr Goindasamy used his whip 6 times prior to the 100 metres. Mr Davidson added there were a further 5 strikes after the 100 metres. HEART OF ALLADIN finished 4th.

Mr Goindasamy agreed with the Stewards’ count. He had not been counting the strikes.

Decision 

As Mr Goindasamy has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record, which evidenced 1 breach of this Rule in the past 6 months. This breach was on 18 December at Ashburton. The number of strikes on that occasion was 7.

Mr Goindasamy confirmed his record.

Reasons for Penalty

The Penalty Guide provides a $250 starting point for a 2nd breach where the count is 6 strikes. The appropriate penalty, having regard to record and number of strikes, is a fine of $250.

Conclusion

Mr Goindasamy is fined the sum of $250.
