BACKGROUND:
Following the running of Race 5, Mr W Pinn, admitted a charge alleging that he had struck his mount, LADYLOU with the whip using an action that raised his arm above shoulder height.
Rule 638(3)(f)(ii) provides:
Without limiting the generality of subrule 638(3), in a Flat Race . . . A Rider must not use his / her whip:
(ii)  using an action that raises the Rider’s arm above shoulder height.
EVIDENCE:
Senior Stipendiary Steward Mr A Dooley, showed a video replay of the field running down the home straight at the 150 metre point. He pointed out LADYLOU, ridden by Mr Pinn. He then demonstrated that Mr Pinn struck his mount twice with the whip, from above shoulder height leading into the 100 metres.
Mr Pinn agreed with the number of strikes.
DECISION:
As Mr Pinn admitted the breach, the Adjudicative Committee finds the charge proved.
SUBMISSIONS ON PENALTY:
Mr Dooley advised that this was Mr Pinn’s first breach within the reset period following a warning on the 26th of April 2024.
Mr Dooley said the penalty for a first offence for whip use above the shoulder is a fine of $250.
Mr Dooley therefore recommended the fine in this case should be $250.
REASONS FOR PENALTY:
The Adjudicative Committee saw no reason to deviate from the Penalty Guide, which for a first offence, provides for a $250 fine.
CONCLUSION:
Mr Pinn, is therefore fined $250.
