Background

Mr Khetoo has admitted a breach of the Whip Rule arising out of the running of Race 6.

The Adjudicative Committee viewed the video of the race in question. Mr Khetoo can be seen to strike his mount ZAMBEZI ZIPPER 8 times before the 100 metres.

Mr Khetoo said it was a mistake on his part and that both he and his mount were getting tired.

Mr Walsh said he was very disappointed at the ride in question. He had been working with Mr Khetoo weekly on Skype. They had had numerous sessions. The Respondent was based at Riverton, and it had been difficult to work with him on a riding simulator, however he had believed that the Respondent had turned the corner. His riding style had been different and his whip action better.

Decision

Mr Khetoo has admitted the breach, so it is found to be proved.

Penalty submissions 

Mr Davidson stated that the Respondent had 3 previous breaches of the Whip Rule in the past 6 months. He had had a mix of fines and suspensions. Mr Davidson said it was a poor record. The starting point for 3 additional strikes was a 5 days plus suspension. He believed a 3 to 4-day uplift was appropriate.

Mr Walsh said he would continue to work with Mr Khetoo who had reverted to his old style when the pressure came on. Mr Khetoo said he had ridden well at Gore and could not explain what had gone wrong today.

Reasons for penalty

Mr Khetoo’s breach is again high end. Eight strikes is unacceptable. Mr Khetoo has used the whip too soon, lost count, and reverted to his old style under pressure. A 3-day uplift to the starting point of a 5 days plus suspension for 3 additional strikes is appropriate when regard is had to record and the repeated nature of his breaches of the Whip Rule.

The parties and the Adjudicative Committee agree that Mr Khetoo should again be referred to the Rider Review Skills Panel.

Conclusion

Mr Khetoo is suspended from the end of racing today up to and including 12 November 2022. This is 8 national riding days.
