EVIDENCE:
Following the running of Race 3, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Apprentice Rider Mr Savish Khetoo.
Mr Khetoo stated he understood the Charge, was conversant with the Rule and confirmed he admitted the breach. Mr Khetoo was assisted at the hearing by Apprentice Mentor Mr Jason Laking.
Mr Davidson played the final straight video to show Mr Khetoo (ZAMBEZI ZIPPER) in the lead and a few metres out from the rail. He pointed to Mr Khetoo strike his horse 7 times before the 100m and then a further 4 times within the last 100m.
Mr Khetoo and Mr Laking agreed with Mr Davidson’s count and chose not to make any comment.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson said Mr Khetoo has a clear record under the Rule. He said the strikes were not forceful and the Stewards assess the breach as low range.
Mr Khetoo and Mr Laking made no submissions on penalty.
REASONS FOR PENALTY:
The Penalty Guidelines provide for a first breach of the Rule, with 2 additional strikes, a fine of $250.
There are no factors present here, for the Adjudicative Committee to depart from the Guidelines on this occasion.
CONCLUSION:
Apprentice Rider Savish Khetoo is fined $250.
