BACKGROUND

Following the running of Race 3, the South Pacific Meats/Logging Fairfax Handicap, an Information was lodged alleging a breach of Rule 638(1)(d) .

Details of the breach are as follows – in that the Respondent, S Khetoo allowed his mount to shift ground inwards under pressure crowding and checking the trailing runner (EARL OF ORKNEY, K Kwo) .

The Respondent acknowledged he understood the Rule and confirmed his admission of the breach.

As Mr Khetoo is an Apprentice Rider he was supported at the hearing by Mr Kelvin Tyler.

Rule 638(i)(d) provides:- A rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Stipendiary Steward, Miss Haley used the available films to demonstrate the incident and identified the horses and Riders concerned.

She highlighted GO LOTTE ridden by Mr Khetoo shifting ground outwards onto EARL OF ORKNEY.

Stipendiary Steward, Mr Davidson said GO LOTTE may have reacted to seeing the whip, however Mr Khetoo did not take any corrective action and that is why we are in the room.

Mr Tyler said Mr Khetoo had made an error of judgement.

DECISION

As Mr Khetoo admitted the breach the Adjudicative Committee found the charge proved.

SUBMISSIONS FOR PENALTY

Mr Davidson produced Mr Khetoo‘s record stating that he received a 6 day suspension at the Otago Racing Club on the 1/11/2022.

Mr Davidson believed the range was mid to low in this instance and that some consideration could be given to Mr Khetoo’s guilty plea.

Mr Khetoo had no submissions as to penalty and was committed to riding on the second day of the meeting on Monday with Riders being declared.

REASONS FOR PENALTY

The Adjudicative Committee considered evidence and submissions as presented and are satisfied the actions of the Respondent represented mid to low range careless riding.  The current Penalty Guidelines provide for a starting point of a 6 day suspension.

This was adopted with a deduction of 1 day which applied to reflect the submission of the charge.

CONCLUSION

Accordingly, Mr Khetoo’s License to ride is suspended from the close of racing on 10 April 2023 up to and including the 20 April 2023, 5 National riding days.
