Evidence:

Following the running of Race 2, the “FOLEYS TRANSPORT WAIPUKURAU HURDLE”, Mr Goodwin presented an Information charging Mr K Wiles, the Rider of “INVISIBLE SPIRIT”, with a breach of Whip Rule 638(3)(f)(ii) in that he used his whip with his arm raised above shoulder height on his mount on one occasion.

Mr Wiles admitted the charge.

The race films depicted “INVISIBLE SPIRIT” jumping the second last fence in the home straight, whereupon landing, it was struck by Mr Wiles using his right arm as applying the whip once with force derived from raising his whip well above his shoulder height.  No other breach of the Whip Rules occurred over the final 350 metres. “INVISIBLE SPIRIT” finished out of the placings of the Judge.

Mr Wiles did not endeavour to justify or explain his error.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

The Informant advised that Mr Wiles has had 57 rides over the last 6 months.  He has a good riding record, incurring one warning, on 13 August 2025, for breaching a Whip Rule.  Mr Wiles accepted that he had to be fined.

Reasons for Penalty:

Taking into account his otherwise good record, and the need to deter other Jumps Riders from similar offending, a fine was deemed to be an appropriate penalty on this occasion.

Conclusion:

A fine of $250 is imposed.
