Penalty: Licensed Jockey Kylan Wiles is suspended for 1 Jumps Riding Day

Evidence:

Following the running of Race 7, the “Rotorua & Bay of Plenty Hunt Landowners Hwt 1400”, and after the Adjudicative Committee had ruled on the protest arising from that race, Mr Jones presented an Information contending that Mr K Wiles, the Rider of “MI AMIGO”, rode carelessly in breach of Rule 638(1)(d).  The details alleged were that he permitted his mount to shift inwards when insufficiently clear of “CHANCELLOR” ridden by M H McNeill, in the home straight.

Mr Wiles admitted the charge.

The essential facts are contained in the Adjudicative Committee’s Decision on the protest which relegated “MI AMIGO” behind “CHANCELLOR” and need not be repeated in detail.  Essentially the actions of Mr Wiles allowed his mount to shift inwards, without any attempt at correction, so as to dictate to “CHANCELLOR” maintaining its line over the concluding stages of the race.  Mr Wiles failed to stop riding and the contact which occurred, on the very narrow finishing margin, cost his mount the first place finish.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Jones submitted that Mr Wiles had a very good clear record and the breach was in the mid range.  It is aggravating that his breach resulted in relegation.  Because Mr Wiles was a Jumps/Highweight Rider, a starting point of 2 days was appropriate and mitigating features were his clear record and frank admission.

Reasons for Penalty:

As a consequence of his error, he lost over $320, being the difference between the first and second riding percentage fees.  That is taken into account as a partial penalty consequence.  But a short suspension must follow.

Conclusion:

Mr Wiles has riding commitments on 26 August, so is entitled to a 7 day deferment.  His suspension will commence at the conclusion of racing on that day 26 August 2023, and will end at the conclusion of racing at Hawera on 3 September 2023 (effectively 4 days but 1 jumps day).
