EVIDENCE

Films of the incident were shown and commented on by Stipendiary Steward N Goodwin. These clearly showed Toni Moki riding her mount and pressing forward, passing two other horses who were in the process of being pulled up. It was clear that NO TEARS had run its race and was tiring.

He was adamant that the horse should have been retired.

NO TEARS finished 82 lengths behind the horse ahead of it.

Jockey T Moki admitted it was an error of judgement. She had recently returned to race riding after a long spell away and the raceday ride had got the better of her.

The horse was vetted after the race and a decision to retire it was decided.

DECISION

As the charge was admitted, it was deemed to be proved.

SUBMISSIONS ON PENALTY

A monetary penalty as per the Guidelines was asked for.

Toni Moki had no comment.

REASONS FOR PENALTY

It could clearly be seen NO TEARS had run its race and was tiring.  Jockey T Moki continued to press forward, urging it past horses who were being retired.

Consideration was given to Jockey T Moki for the admittance of the breach. She had not been charged under this Rule before.

While she had recently returned to race riding, it was her responsibility to be aware of the Rules.

While the Penalty Guidelines indicated a fine of $300, an uplift on that was deemed appropriate because of the Jockey’s actions on a tiring horse.

CONCLUSION

Jockey Toni Moki was fined $350.
